General Conditions of Sale (GCS) of Dianistore
Preamble
These general terms and conditions of sale (hereinafter the "GTC") govern the contractual relations between the micro-enterprise Dianistore, whose head office is located at 4 Rue de l'Indépendance, 8327 Mamer, Luxembourg (hereinafter the "Seller"), and any natural or legal person wishing to make a purchase on the website https://dianistore.shop/collections (hereinafter the "Site").
Article 1 - Purpose
These General Terms and Conditions aim to define the legal and commercial conditions under which the Seller offers and sells its products to customers (hereinafter the "Customers") on the Site.
Article 2 - Products
The products offered for sale on the Site (hereinafter the "Products") are described and presented on the Site with the essential characteristics, in accordance with the provisions of article L.111-1 of the Consumer Code.
The Products are manufactured with quality materials and components, in accordance with current standards.
The Seller undertakes to provide the Customer with Products that comply with the description appearing on the Site.
Article 3 - Price
The prices of the Products appearing on the Site are indicated in euros (€) and are inclusive of all taxes (TTC), excluding delivery costs.
Delivery costs are charged in addition to the price of the Products and are clearly indicated on the Site before validation of the order.
The Seller reserves the right to modify its prices at any time.
Article 4 - Order
The Customer can place his order on the Site by following the different stages of the ordering process.
The Customer must create an account or log in to their existing account before placing their order.
The Customer must then select the Products he wishes to purchase, add them to his basket and confirm his order.
The Customer must then provide their delivery and payment information.
The Customer must finally confirm his order by accepting these General Terms and Conditions and clicking on the "Validate order" button.
The Customer's order is confirmed by the Seller by sending a confirmation email summarizing the details of the order.
Article 5 - Payment
Payment for Products is made by bank card, via a secure payment platform.
Payment is secure and the Customer's banking data is never stored on the Seller's Site.
The Seller may only ship the Products after full payment has been received.
Article 6 - Delivery
The Products are delivered to the delivery address indicated by the Customer when ordering.
The delivery time is [specify delivery time] from the validation of the order.
The Seller undertakes to deliver the Products within a reasonable time. In the event of the delivery time being exceeded, the Customer may terminate the contract or request delivery at a later date.
The Products are delivered by an independent carrier. The Customer will be informed of the tracking number of his package by email.
The Customer is required to check the condition of the Products upon delivery. In the event of a problem, the Customer must contact the Seller within 24 hours of delivery.
Article 7 - Right of withdrawal
The Customer has a right of withdrawal of 14 days from receipt of the Products.
To exercise his right of withdrawal, the Customer must inform the Seller of his decision by email to the following address: [Your email address].
The Customer may also use the withdrawal form available on the Site.
In the event of withdrawal, the Customer must return the Products to the Seller within 14 days of notification of his decision to withdraw.
The cost of returning the Products shall be borne by the Customer.
The Seller will reimburse the Customer for the total amount of his order, including delivery costs, within 14 days of receipt of the returned Products or proof of shipment of the returned Products.
Article 8 - Legal guarantee
The Seller is bound by the legal guarantee of conformity of the Products ( articles L.217-1 et seq. of the Consumer Code) and the guarantee of hidden defects (articles 1641 et seq. of the Civil Code).
In the event of non-conformity of the Product, the Customer may choose between:
- The repair or replacement of the Product.
- A reduction in the price of the Product.
- Termination of the contract and reimbursement of the Product.
The Customer must inform the Seller of the lack of conformity within two years from delivery of the Product.
The Seller undertakes to repair or replace the defective Product within a reasonable time.
If repair or replacement of the Product is not possible, the Seller will offer the Customer a reduction in the price of the Product or termination of the contract.
Article 9 - Liability
The Seller shall not be held liable for any direct or indirect damage resulting from the use of the Products, including damage resulting from improper use or negligence by the Customer.
The Seller shall not be held liable for damage resulting from acts of God, such as natural disasters, fires or floods.
Article 10 - Intellectual property
All elements appearing on the Site, such as texts, images, videos and sounds, are protected by copyright and intellectual property law.
Any reproduction, representation, distribution or modification, partial or total, of the content of the Site is prohibited without the express written authorization of the Seller.
Article 11 - Applicable law and competent jurisdiction
These T&Cs are governed by Luxembourg law and any dispute relating to these T&Cs will be subject to the jurisdiction of the Luxembourg courts.
Article 12 - Modification of the General Conditions of Sale
The Seller reserves the right to modify these General Terms and Conditions at any time.
Changes to the T&Cs will apply to orders placed after the date of publication of the changes on the Site.
Article 13 - Acceptance of the T&Cs
The Customer acknowledges having read these General Terms and Conditions and having accepted them before placing their order.
The Customer accepts these General Terms and Conditions by checking the box "I have read and accept the general terms and conditions of sale" when confirming their order.
